Chapter 7
Chapter 7 bankruptcy gives people a fresh start. It is a bankruptcy used to completely wipe out most debts in a legal proceeding conducted under the jurisdiction of the Federal U.S. Bankruptcy Court. Chapter 7 discharges debts such as credit card debt, medical bills, personal loans, delinquent utility bills, old tax debt, and deficiencies on repossessed vehicles. Under Chapter 7 bankruptcy, you will never have to pay your creditors for these types of debts. Most of our clients are able to keep their property when they file for Chapter 7 bankruptcy. However, it is important to be current on vehicle and/or house payments if you want to file a Chapter 7 and keep your property.
Chapter 13
Chapter 13 bankruptcy protects your property and helps you reorganize and reduce other debts. A Chapter 13 places your home under the protection of the U.S. Bankruptcy Court and stops foreclosures. It also puts your vehicle under the same Bankruptcy Court protection and prevents your car from being repossessed. Chapter 13 is used primarily by people with a mortgage or a vehicle who wish to keep their property, yet need time to restructure payment of existing debt to a manageable level. In many cases, depending on your income and assets, you may be able to completely eliminate your unsecured debt through a Chapter 13 Bankruptcy filing. This means you may not have to pay credit card debt, medical bills, personal loans, delinquent utility bills and certain other unsecured debt.
